Lawmakers play waiting game with “fiscal cliff” deadline in sight






WASHINGTON (Reuters) – With only a week left before a deadline for the United States to go over a “fiscal cliff,” lawmakers played a waiting game on Monday in the hope that someone will produce a plan to avoid harsh budget cuts and higher taxes for most Americans from New Year’s Day.


Though Republicans and Democrats have spent the better part of a year describing a plunge off the cliff as a looming catastrophe, the nation’s capital showed no outward signs of worry, let alone impending calamity.






The White House has set up shop in Hawaii, where President Barack Obama is vacationing.


The Capitol was deserted and the Treasury Department – which would have to do a lot of last-minute number-crunching with or without a deal – was closed.


So were all other federal government offices, with Obama having followed a tradition of declaring the Monday before a Tuesday Christmas a holiday for government employees, notwithstanding the approaching fiscal cliff.


Expectations for some 11th-hour rescue focused largely on Senate Minority Leader Mitch McConnell, a Republican, in part because he has performed the role of legislative wizard in previous stalemates.


But McConnell, who is up for re-election in 2014, was shunning the role this year, his spokesman saying that it was now up to the Democrats in the Senate to make the next move.


“We don’t yet know what Senator Reid will bring to the floor. He is not negotiating with us and the president is out of town,” said McConnell’s spokesman, referring to Senate Majority Leader Harry Reid, a Democrat. “So I just don’t know what they’re going to do over there,” he said.


Two-day-old tweets on leadership websites told the story insofar as it was visible to the public.


House Speaker John Boehner‘s referred everyone to McConnell. McConnell’s tweet passed the responsibility along to Obama, saying it was a “moment that calls for presidential leadership.”


Reid’s tweet said: “There will be very serious consequences for millions of families if Congress fails to act” on the cliff.


The next session of the Senate is set for Thursday, but the issues presented by across-the-board tax hikes and indiscriminate reductions in government spending, were not on the calendar.


The House has nothing on its schedule for the week, but members have been told they could be called back at 48 hours notice, making a Thursday return a theoretical possibility.


However, aides to the Republican leaders in Congress said there were no talks with Democrats on Monday and none scheduled after negotiations fell off track last week when Boehner failed to persuade House Republicans to accept tax increases on incomes of more than $ 1 million a year.


“Nothing new, Merry Christmas,” an aide to Boehner responded when asked if there was any movement on the fiscal cliff.


SCALED-BACK EXPECTATIONS


If there is some last-minute legislation, Republicans and Democrats agreed on Sunday news shows that it will not be any sort of “grand bargain” encompassing taxes and spending cuts, but most likely a short-term deal putting everything off for a few weeks or months, thereby risking a negative market reaction.


A limited agreement would still need bipartisan support, as Obama has said he would veto a bill that does not raise taxes on the wealthiest Americans.


On Monday, Texas Senator Kay Bailey Hutchison urged fellow Republicans to be flexible.


“We’re now at a point where we’re not going to get what we think is right for our economy and our country because we don’t control government. So we’ve got to work within the system we have,” she told MSNBC.


Two bills in Congress could conceivably form the basis for a last-minute stopgap measure.


Last spring, Republicans in the House passed a measure that would extend Bush-era tax cuts for everyone, reflecting the party’s deep reluctance to increase taxes.


The Democratic-controlled Senate passed a bill in August, extending lower tax rates for everyone except the wealthiest Americans – a group defined at that point as households with a net income of $ 250,000 or above. Obama has since increased that to $ 400,000 a year, in an effort to win Republican support.


Analysts say Democrats might be able to get the backing of enough Republicans in both the House and Senate, especially if they are willing to raise the number to $ 500,000.


Under that scenario, lawmakers might also put off spending cuts of $ 109 billion that would take effect from January and agree to Republican demands for cuts in entitlement programs such as Medicare and Medicaid, the government-run health insurance plans for seniors and the poor.


However, with only a few work days left in Congress after Christmas, there is a good chance that no deal can be worked out and tax rates would then go up, at least briefly, until an agreement is reached in Washington.


“We may go off the cliff on January 1, but we would correct that very quickly thereafter,” Democratic Representative John Yarmuth told MSNBC.


The prospects of the United States going over the fiscal cliff dampened enthusiasm on Wall Street for a “Santa rally” in the holiday season, when stocks traditionally rise.


The Dow Jones industrial average dropped 51.76 points, or 0.39 percent, in Monday’s shortened holiday session.


Failure to work out tax rates in the coming days would cause chaos at the Internal Revenue Service, said analyst Chris Krueger of Guggenheim Securities.


“Next weekend is going to be a total, total debacle,” he said. The IRS is unlikely to have enough time to revise its tables for withholding taxes.


“The withholding tables are sort of like an aircraft carrier, you can’t turn the thing on a dime.” he said.

Firefighters ambushed by gunman while responding to house fire

A man with a criminal history shot and killed two West Webster, N.Y. firefighters and seriously injured two others as they responded to a fire at his home., police say.


William Spengler, 62, apparently started a 5:35 a.m. fire at his home on Lake Road  and then waited with an armament of weapons for first responders to arrive, Webster N.Y. Police Chief Gerald Pickering said at an afternoon news conference.


“He was shooting from high ground or a berm," Pickering said. "He was barricaded with weapons to shoot first responders."


After a brief exchange of gunfire with police, Spengler then shot and killed himself at the scene, Pickering said.


Spengler was convicted in 1981 in the death of his 92-year-old grandmother a year earlier. He served time in prison and was released in 1998, Pickering said.


Spengler beat Rose Spengler, who then lived in the house next door on Lake Road, to death with a hammer in 1980, the Rochester Democrat and Chronicle reported.


Local police had not noted any criminal activity in his recent past, Pickering said.


Pickering said they are looking into the apparent disappearance of Pickering's sister who is unaccounted for at this time.


Police and fire officials are continuing to gather evidence and will inspect the seven homes that were destroyed in the fire that spread to nearby houses in the small lakeside town located 10 miles east of Rochester.


The victims in the shooting are Mike Chiapperini, also a lieutenant and public information officer with the local police department, and Tomasz Kaczowka, Pickering said.


"These people get up in the middle of the night to fight fires. They don't expect to be shot and killed," a tearful Pickering said at the press conference.


Chiapperini was described by Pickering as a lifelong firefighter who started with the department's explorer program and had about 20 years of experience. Kaczowka was a younger firefighter who was on the force for about two years and was also a 911 dispatcher, he said.


West Webster firefighters Joseph Hofsetter and Theodore Scardino were seriously injured and are at Strong Memorial Hospital with gunshot wounds, a hospital spokeswoman said.  Scardino  has  injuries to his chest and lungs. Hofsetter was injured in the pelvis, the spokeswoman said at a media briefing. Both are in guarded condition, she said.


An off-duty police officer from nearby Greece, N.Y., John Ritter was also injured by shrapnel during the shooting, Pickering said.


Pickering said that one of the firefighters who survived made his way across a bridge to safety. The other three did not make it across, Pickering said. Police arrived and rescued the other three firefighters, but two were fatally shot, Pickering said.


The morning scene was described as chaotic as police and firefighters dealt with an immense blaze as well as gunshots,  local news station WHAM-TV  reports.


“I’m not aware of anything like this happening in Webster, obviously not a firefighter being fired upon,” Webster Fire Marshal Rob Boutillier told the Democrat and Chronicle.  Pickering described Webster as resort lakeside community that is quiet and usually peaceful.


WHAM reported that an outpouring of support has come through the Webster community. Black flags reportedly have been draped at some homes and offices to honor those killed and injured.


N.Y. Gov. Andrew Cuomo tweeted of the incident: We as the community of #NY mourn their loss as now 2 more families must spend the holidays without their loved ones #Webster

Britain’s Queen Elizabeth goes 3D for Olympics tribute






LONDON (Reuters) – Britain‘s Queen Elizabeth will use her traditional Christmas Day message, filmed in 3D for the first time, to pay tribute to the world’s athletes for delivering a “splendid summer of sport” at the London Olympics.


In her personal address to the nation, the monarch will pay tribute to the competitors’ “skill, dedication, training and teamwork”, her office said on Monday.






The 86-year-old head of state provided an Olympic highlight when she made a surprise comic turn with James Bond actor Daniel Craig in a short film for the opening ceremony.


“In pursuing their own sporting goals, they gave the rest of us the opportunity to share something of the excitement and drama,” she will say, according to advance extracts.


Queen Elizabeth missed a church service at her country retreat on Sunday due to a cold, Buckingham Palace said. Her message was pre-recorded and will go out as expected.


It comes at the end of a landmark year for the royal family.


Queen Elizabeth marked 60 years on the throne with the Diamond Jubilee celebrations and her grandson Prince William and his wife Kate are expecting their first baby.


Prime Minister David Cameron issued his own Christmas message in which he talked of Britain’s “extraordinary year”.


“We cheered our queen to the rafters with the Jubilee, showed the world what we’re made of by staging the most spectacular Olympic and Paralympic Games ever and – let’s not forget – punched way above our weight in the medals table,” he said.


The first Christmas broadcast was given by Queen Elizabeth’s grandfather George V in 1932. It has become a Christmas Day tradition for many families to watch it together after lunch.

Fifth-gen iPad reportedly due in March along with Retina iPad mini







Rumors that a second-generation iPad mini with a Retina display is set to launch ahead of Apple’s typical annual schedule next year have been swirling, and now it appears Apple’s (AAPL) full-size iPad may be sticking to its new semiannual release schedule. According to a report from Japanese blog Makotakra that cites an anonymous “inside source,” Apple plans to launch a new thinner, lighter 9.7-inch iPad as soon as March 2013. The fourth iPad model was just released last month alongside the iPad mini, but March was also suggested in recent Retina iPad mini rumors. Makotakra states that the new iPad will adopt styling queues from the current iPad mini model, unifying the look of Apple’s larger tablet with the iPad mini and iPhone 5.

Syria jets kill tens as international envoy visits






BEIRUT (AP) — A government airstrike on a bakery in a rebel-held town in central Syria killed more than 60 people on Sunday, activists said, casting a pall over a visit by the international envoy charged with negotiating an end to the country’s civil war.


The strike on the town of Halfaya left scattered bodies and debris up and down a street, and more than a dozen dead and wounded were trapped in tangled heap of dirt and rubble.






The attack appeared to be the government response to a newly announced rebel offensive seeking to drive the Syrian army from a constellation of towns and village north of the central city of Hama. Halfaya was the first of the area’s towns to be “liberated” by rebel fighters, and activists saw Sunday’s attack as payback.


“Halfaya was the first and biggest victory in the Hama countryside,” said Hama activist Mousab Alhamadee via Skype. “That’s why the regime is punishing them in this way.”


The total death toll remained unclear, but the Britain-based Syrian Observatory for Human Rights said more than 60 people were killed. That number is expected to rise, it said, because some 50 of those wounded in the strike are in critical condition.


Amateur videos posted online Sunday showed residents and armed rebels rushing to the scene. One stopped to cover a mound of human flesh lying in the street with his coat.


More than a dozen dead or seriously wounded people lay in the street near a simple, concrete building, some in puddles of blood. Near its front wall, bodies jutted from a pile of dirt and rubble on the sidewalk.


Rebels screamed in distress while trying to extract the bodies, while others carried away the wounded.


It was unclear from the videos if the building was indeed a bakery. Nearly all the dead and wounded appeared to be men, some wore camouflage, raising the possibility that the jet had targeted a rebel gathering.


For the past week, rebels have been launching attacks in the area, most notably in the nearby village of Morek, where they hope to seize control of the country’s main north-south highway, preventing the regime from getting supplies to its forces further north in the provinces of Idlib and Aleppo.


On Saturday, one rebel group threatened to storm two predominantly Christian towns nearby if their residents did not “evict” government troops they said were using them as a base to attack nearby areas.


The activist accounts could not be independently verified due to restrictions on reporting in Syria. The Syrian government does not respond to requests for comment on its military activities.


The attack coincided with the start of a two-day visit by Lakhdar Barhimi, who represents the U.N. And the Arab League, to meet with top Syrian officials.


Brahimi has made little apparent progress toward ending Syria’s crisis since assuming his post in September, mostly because the sides appear more interested in fighting it out than in sitting down for talks.


Brahimi did not speak publicly upon arriving in Damascus for a two-day mission, and it was unclear whether he would present new ideas to end the war. His trip appeared troubled from the start.


Instead of flying directly to Syria as he had on previous visits, Brahimi landed in Beirut and traveled to the Syrian capital by land because of fighting near the Damascus airport, Lebanese officials said.


The Lebanese officials, who spoke on condition of anonymity because they were not authorized to brief reporters, said Brahimi was expected to meet Syria’s foreign minister later Sunday and President Bashar Assad on Monday.


The trip is Brahimi’s third since taking the job following the resignation of former U.N. Secretary General Kofi Annan after both sides disregarded a cease-fire he brokered in April.


While not advancing a comprehensive peace plan, Brahimi has called on the sides to negotiate a solution.


The security situation has gotten notably worse for the regime since his last visit, with rebels storming a number of military bases and seizing valuable munitions. Russia, Assad’s most powerful international backer, also appears to have changed his assessment of Assad’s strength, as top officials say they do not seek to preserve his regime, while still calling for a negotiated solution.


Still, neither side appears willing to talk.


In a lengthy Sunday news conference, Syrian Information Minister Omran al-Zoubi repeated the Syrian government’s line that it is fighting terrorist groups backed by foreign powers who seek to destroy Syria.


Al-Zoubi said the government was willing to engage in dialogue but said the other side wasn’t.


“We speak of dialogue with those who believe in national dialogue,” he said. “But those who rejected dialogue in their statements and called for arms and use of weapons, that’s a different issue. They don’t want dialogue.”


Rebel groups refuse to talk to Assad, saying too many people have died for him to be considered part of the solution.


Violence raged elsewhere in the country on Sunday. Anti-regime activists reported government airstrikes on suburbs east of the capital and the northern province of Aleppo.


Airstrikes on the town of al-Safira, south of Aleppo, killed 13 people, including a mother and five daughters from one family, a local activist named Hussein said via Skype. He gave only his first name for fear of retribution.


The town lies next to a large military complex with factories and artillery and air defense bases. Hussein guessed the airstrike was payback for recent rebel attacks on the complex.


“The strikes don’t hit the fighters at all,” he said. “They want to take revenge on the civilians.”


The Observatory said at least 10 rebels and an unknown number of government troops were killed in clashes in Afreen, near Aleppo, Syria’s largest city, as rebels sought to storm an army base there.


Anti-regime activists say more than 40,000 people have been killed since Syria’s crisis began in March 2011.

Former President George H.W. Bush remains hospitalized






(Reuters) – Former President George H.W. Bush, who has been hospitalized for a month undergoing treatment for bronchitis, may not be released from a Houston hospital in time to celebrate Christmas at home as doctors had hoped.


Bush, 88, remained in stable condition and doctors were optimistic he would make a full recovery, George Kovacik, a spokesman at Methodist Hospital, said in an emailed statement on Sunday.






But doctors were being “extra cautious” with his care and no discharge date had been set, the statement said. Earlier this month, Kovacik said doctors expected Bush would be able to spend Christmas at home with his family.


“His doctors feel he should build up his energy before going home,” the statement said.


Bush, the 41st president and a Republican, took office in 1989 and served one term in the White House. The father of former President George W. Bush, he also is a former congressman, U.N. ambassador, CIA director and vice president for two terms under Ronald Reagan.

NRA’s LaPierre: New gun laws won't work

Two days after suggesting a "good guy with a gun" be stationed at every school in the country in response to the deadly shootings in Newtown, Conn., National Rifle Association executive vice president Wayne LaPierre blasted critics of his plan.


In an interview broadcast on Sunday's "Meet The Press," LaPierre reiterated the statements he made Friday at a press conference in Washington, when he said the answer to preventing shootings like the one at Sandy Hook Elementary Sch00l is armed security in every school--in effect, protecting children with guns.


“If it’s crazy to call for putting police in and securing our schools to protect our children, then call me crazy," LaPierre said. “I think the American people think it’s crazy not to do it."


At one point during the often contentious exchange, host David Gregory held up a high-capacity magazine clip that carries 30 bullets, asking if the NRA would support a federal limit on the capacity of such clips.


"Isn't it just possible that we could reduce the carnage in a situation like Newtown?" Gregory asked.


"I don't believe that's going to make one difference," LaPierre responded.


"You're telling me that it's not a matter of common sense that if you don't have an ability to shoot off 30 rounds without reloading, that, just possibly, you could reduce the loss of life?" Gregory asked.


"I don't buy your argument for a minute," LaPierre said. "There are so many different ways to evade that, even if you had that."


“Is there no new gun regulation you would support?” an exasperated Gregory asked. LaPierre refused to answer.


At Friday's press conference, LaPierre--who did not take questions from reporters--argued that had someone at the school been armed, "innocent lives might have been spared."


"The only thing that stops a bad guy with a gun is a good guy with a gun," he said.

South Africa’s Mandela responding to treatment in hospital






JOHANNESBURG (Reuters) – Former South African president and anti-apartheid hero Nelson Mandela, who is 94, continues to respond to treatment two weeks after being taken to hospital, the government said on Saturday.


The Nobel Peace laureate, who has been treated for a lung infection and gallstones after being hospitalized on December 8, was visited by South African President Jacob Zuma, presidency spokesman Mac Maharaj said in a statement.






“Madiba has been in hospital since the 8th of December and continues to respond to treatment,” Maharaj said, referring to Mandela by his clan name.


President Zuma assured him of the love and support of all South Africans, young and old, and the whole world.”


The country’s first black president was admitted to hospital in Pretoria earlier this month after being flown from his home village of Qunu in a remote part of the Eastern Cape province.


It seems likely that Mandela, admired at home and abroad as a global icon against injustice for his lifetime of struggle against minority white rule, will end up spending Christmas in the hospital.


On Thursday, following his re-election as leader of the ruling African National Congress (ANC), Zuma reported Mandela had “steadily improved”.


Zuma said then the former president was receiving “the best care possible” but recalled that Mandela was “at an age where medical challenges require extraordinary care”.


He praised Mandela as an “unparalleled fighter”.


In an interview broadcast on Saturday but recorded a day earlier, the ANC’s newly elected Deputy President Cyril Ramaphosa said he believed Mandela was “on the mend”.


Mandela spent 27 years in apartheid prisons, including 18 years on the windswept Robben Island off Cape Town. He was released in 1990 and went on to use his prestige to push for reconciliation between whites and blacks as the bedrock of the post-apartheid “Rainbow Nation”.


He stepped down in 1999 after one term in office and has been largely removed from public life for the last decade.


Mandela spent time in a Johannesburg hospital in 2011 with a respiratory condition, and again in February this year because of abdominal pains. He was released the following day after a keyhole examination showed there was nothing serious.


He has since spent most of his time in Qunu.


His fragile health prevents him from making any public appearances in South Africa, although he has continued to receive high-profile domestic and international visitors, including former U.S. president Bill Clinton in July.

This week, the top comments on Mashable brought into focus both the state of the world around us and the constantly changing nature of our virtual lives. Our readers launched into debate when Instagram appeared to be making drastic changes to its privacy policy. Based on the wording of Instagram’s new Terms of Service, photographers worried that they may no longer own the rights to their own work, and that their photos could be used in advertising. As Mashable‘s Chris Taylor put it, the TOS as they stood early this week basically “signed your life away.”

Canada spending growth sluggish in November, Mastercard says






(Reuters) – Canada‘s holiday shopping season got off to a slow start in November with retail sales rising only 1.3 percent from the previous year, compared with 4.2 percent growth a year earlier, according to data released by MasterCard on Thursday.


Still, the shopping season was still young in November. MasterCard Advisors, the payment company’s research and consulting division, found that in recent years, holiday shopping peaks from December 20 to December 22.






“Many Canadians may have gotten an early start with Black Friday and Cyber Monday this year, but it’s still a very young phenomenon in Canada,” Senior Vice-President Richard McLaughlin, said in a release.


The Friday after U.S. Thanksgiving is the unofficial start to the holiday shopping season south of the border, and in recent years retailers have imported Black Friday sales to Canada.


Some also promote online sales the following Monday.


Canada’s online retail sales continued to grow in November, increasing 26.4 percent.
